Appeal Process

You or your loved one must file the Notice of Appeal with the county clerk of courts within 30 days of the day of sentencing in order to exercise your right to a direct appeal. Another option is filing a Motion for Reconsideration within ten days of sentencing to temporarily pause the thirty-day window to file a Notice of Appeal. However, if the judges deny the Motion for Reconsideration, the clock starts again with a new 30-day window. If the court doesn’t make a decision on the Motion for Reconsideration within 120 days, then it is automatically denied.

The Motion for Reconsideration can be filed to challenge the sufficiency of the evidence or the sentence. Before you can appeal a case, this motion needs to be filed to give the court a chance to correct their errors. The direct appeal starts when the Motion for Reconsideration is denied.
